Administration impacts CFPB ODP lawsuit

Credit unions collaborate not only to support each other but also to combat shared challenges. That’s why the League led an 18-league amicus brief backing Americas Credit Union’s lawsuit against the Consumer Financial Protection Bureau’s (CFPB) overdraft lending (ODP) rule. The case remains active with a decision pending on America’s Credit Unions preliminary injunction. Last week, as the Administration team took over the CFPB, directives were issued to halt enforcement, public commentary, and rulemaking actions—including a 90-day stay on the ODP rule and litigation. Consumer groups have moved to intervene, but the CFPB’s pause signals an early victory. The League will continue monitoring developments and share updates.
