CCPA: A Credit Union’s Perspective webinar

This session will cover the current state of the California Consumer Privacy Act of 2018 (“CCPA”) as potentially applicable to credit unions. The presentation will address the CCPA’s potential application to California and out-of-state credit unions, various financial sector regulatory exemptions to the CCPA, and discuss the status and developments in regulatory and judicial interpretation regarding a potential exemption based on the “non-profit” status of credit unions. The presentation will also address such operational issues as development and integration of privacy policies and notices, responding to consumer requests under the CCPA, identity verification requirements for consumer requests, identifying data sets may be subject to the CCPA and outside the scope of regulatory exemptions and what vendor agreements need to include regarding CCPA compliance. We will also briefly address the changes made to the CCPA by the California Privacy Rights Act of 2020 (“CPRA”), the status of the formation and delegated authority to a consumer agency tasked with enforcing the CCPA, and any notable developments of CCPA-like statutes developing in other states or at the federal level. Lastly, as many credit unions have members in Europe, this presentation will address the General Data Protection Regulation (“GDPR”) briefly and in reference to its potential extraterritorial application and whether compliance with the GDPR is sufficient to satisfy the CCPA.
