Ensuring that your members have the resources and services they need to meet kitchen table realities can be a daily challenge. That is why the League got involved in America’s Credit Unions’ (ACU) lawsuit against the Consumer Financail Protection Bureau (CFPB) and its Overdraft Lending (ODP) rule, which attempted to cap ODP at $5. For more than a year, the League, ACU, and all of you have been fighting back together against this rule’s unnecessary intrusion into decisions you make with members. Thankfully, that hard work in the judicial arena over the last six months paid off, and we have won.
ACU et al’s, motion to dismiss the case as moot was granted late last week, just days after President Trump signed a Congressional Review Act (CRA) resolution to prevent the rule from becoming effective. This represents one of the biggest legal victories the credit union system has been a part of in some time. This also shows the power of continued, sustained, and coordinated advocacy. Our collective work in the public comment period, our meetings with the CFPB, and now our court filings, all played vital parts in getting us here today. The League remains committed to ensuring decisions and agreements between you and your members are best left to those involved: you and your members.
